Laura C. Baucus and Joseph H. Hickey, both of whom are members of Dykema’s Financial Services Litigation practice group, will serve as featured speakers at the American Conference Institute (ACI) 26th National Forum on Residential Mortgage Regulatory Enforcement & Litigation. Baucus is also Co-Chairing the two-day event, which is set to take place at the Omni Dallas Hotel Park West from Oct. 29-30 in Dallas, Texas.
Baucus, who is Leader of Dykema’s Financial Services Litigation practice group, will join representatives from both Fannie Mae and Freddie Mac for the presentation “Examining the Technological and Legal Developments in Digital Mortgages and the IMpact on the Rise of a Non-Traditional Lender.” The discussion will address:

- Current adoption and status of investor acceptance
- eVault and transfer models

- How a “bailee” is addressed with eNotes
- Data standardization
- Upcoming changes for “Secured Party"

Hickey will co-present “Fair Lending and Equal Opportunity Laws Roundup: What Does the Residential Mortgage Industry Need to Be Aware of Now,” which will cover:
- Examining the increased focus on affordable housing and fair lending in the coming months
- Redlining risks: How frequently do lenders perform redlining analysis?
- Current developments with enforcement actions by the DOJ
- What kind of data analysis should a lender be doing to understand if it has a redlining risk?
- Who should a lender compare itself to when examining this risk?

In addition to Baucus and Hickey, The Honorable Christine A. Nowak, U.S. Magistrate Judge of the U.S. District Court, Eastern District of Texas—and Dykema alumna—will also be featured in a presentation titled, “Judicial Insights on Emerging and Most Important Decisions that Will Be Impacting Residential Mortgage Industry.” This presentation will discuss what issues and cases will continue to shape the residential mortgage industry and will also examine the trend involving judges’ reluctance to rule on many issues and make decisions, which in turn make this type of litigation difficult and long.
