Brian Smith Discusses Proposed Michigan COVID Liability Laws in Crain’s Detroit Business

Brian Smith, Bloomfield Hills-based Member in Dykema’s Litigation Department, was quoted in the Crain’s Detroit Business article, “Covered in case of COVID? House debates new liability protections for businesses.”

In the article, Smith commented on new bills pending with the Michigan House Judiciary Committee that would extend protections to businesses that serve customers and to those which make health care products. According to Smith, it would be difficult for plaintiffs to prove where they contracted COVID-19, such as a particular place of business, so the bills may be ineffective.
