Rex Schlaybaugh, Jr., Bloomfield Hills-based member and Chairman Emeritus of the Firm, and Brian Moore, also Bloomfield Hills-based and a member in Dykema’s Litigation Department, shared their insights and discussed best practices in a webinar—presented to the Association of Corporate Counsel, Michigan Chapter—themed “Conducting an Effective Internal Investigation.”
Schlaybaugh and Moore were joined by Robert Biskup from Deloitte Financial Advisory Services in this 90-minute event, held on June 10, 2014.
Citing the continued rise in internal corporate investigations, Schlaybaugh, Moore and their co-presenter discussed the reasons for the recent rise in internal investigations, and provided practical guidance on such issues as:
- The factors that should be considered in assessing when an internal investigation is warranted, and who should conduct the investigation
- The role of management and the board of directors in such investigations
- A step-by-step guide to conducting internal investigations
- Protecting attorney-client and work-product privileges
- Disclosing investigation results (including waiver of privileges)
- SEC and other regulatory concerns
