We examine how the Department of Justice pursued criminal charges under 18 U.S.C. §1519 for filing reports under NHTSA’s Standing General Order. We will look at the example of the Cruise Deferred Prosecution Agreement; the potential for courts to limit §1519 liability after the Supreme Court’s recent decision in Fischer v. United States, limiting the scope of a similar Sarbanes-Oxley Act criminal charge; and the need to evaluate reporting processes in your organizations for criminal risks.
