How May I Help You? Reasonable Accommodations Including Leaves of Absence

It is 10:00 am on a normal workday. Do you know what state your employees live in?

Just knowing the names of the applicable laws and what they state is complicated enough but trying to interpret and apply them in a compliant manner takes it to another level. As an illustration, the Americans with Disabilities Act, as amended (ADA), establishes the requirement that employers with fifteen or more employees provide individuals with reasonable accommodations in certain situations based on medical conditions. The ADA gives little insight as to when such accommodations must be initiated or even factors to consider. But, as an example, remote work due to COVID restrictions seems to show that working away from a physical office is quite viable for many jobs. Does this now mean that employers must always allow remote work when a medical condition limiting a person’s ability to work onsite is involved? Similarly, must leaves of absence be implemented for employees who need time off from work? If yes, how often, how long and will it be job protected? To complicate things more, the Family and Medical Leave Act (FMLA) requires employers with fifty or more employees to allow leaves of absences for qualifying reasons. Many of those situations overlap with the ADA reasonable accommodation requirements where leaves of absence may be used. This session is designed to review when reasonable accommodations, such as remote work, and leaves of absence are mandated or just a good business practice. So many questions about leaves of absence and reasonable accommodations exist and we will address many of them.
