Dan Harkins, San Antonio-based Member and Director of Dykema’s Intellectual Property and IP Litigation Department, was quoted in the Law360 article, “Barrett’s Textualist Focus Offers Few Clues On IP Approach.”
In the article, multiple attorneys speculated as to how U.S. Circuit Judge Amy Coney Barrett might approach IP cases if she is confirmed to the U.S. Supreme Court. Her small record on Intellectual Property has made it challenging to predict how she will handle cases. Harkins said, “…she's likely to be strict if she ever has to handle issues of claim construction in patent cases, in the same way she'd strictly analyze the language of the Copyright Act or Lanham Act.”
