In May 2016, the U.S. Supreme Court issued its long awaited decision in Robins v. Spokeo which clarified whether and when a plaintiff has Article III standing to bring a claim for statutory damages where there is no allegation of actual injury. The decision impacts a wide range of consumer and other class actions brought under federal law that allow for the recovery of statutory damages in the absence of actual damages. Since Spokeo, there have been in excess of 170 federal court decisions interpreting and applying the ruling in a wide variety of contexts including the Fair and Accurate Credit Transaction Act, the Fair Credit Reporting Act, the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
