Clients come to Kyle Asher with their most pressing appeals, class actions, and regulatory matters. Although his clients (which include some of the country’s largest automakers, universities, and insurers) and the venues he represents them in (ranging from federal courts to state administrative bodies) may vary, what sets him apart from other attorneys does not. He is efficient, highly responsive, and—drawing on his federal clerkship experience—has a knack for identifying the issues that cases will turn on, building a case around those issues, and persuasively distilling the facts and law in a way that ultimately leads to success.
Appeals and Litigation
The bulk of Kyle’s time is spent defending businesses and individuals in high-stakes appeals, class actions, and other litigation in venues across the country.
At the appellate level, in the past year alone, Kyle has drafted over a dozen appeal briefs and presented oral argument before the Michigan Court of Appeals on several occasions. Before that, he was appointed as a Special Assistant Attorney General by Michigan Attorney General Bill Schuette to represent the State’s interests before the Michigan Supreme Court. A sampling of his successful outcomes is available here. He is also frequently hired to serve as embedded appellate counsel at the trial level. His past experience clerking for a United States District Judge—which involved drafting numerous jury instructions, verdict forms, and providing immediate and appeal-proof recommendations on evidentiary issues raised at trial—has proved invaluable in this regard.
At the trial level, Kyle specializes in federal procedure and jurisdiction, critical motion practice, and crafting strategy to defeat class certification. He is currently representing clients in some of the State’s most pressing class actions, including the representation of a major law firm in a data breach class action; automotive manufacturers in numerous class actions involving breach of warranty claims; several of the state’s largest municipalities in class actions involving federal takings claims; and an insurance company in multiple class actions centering on coverage denials.
Regulatory Matters
In addition to the above, some of Kyle’s most value-added work involves keeping clients out of the courtroom and away from regulatory scrutiny. Kyle provides compliance advice to clients operating in highly-regulated industries—with a particular focus on energy, liquor licensing, and insurance law—to keep them on the right side of the law and to avoid enforcement actions and litigation. He regularly appears before the Michigan Liquor Control Commission and Michigan Public Service Commission.
