Automotive Supply Chain
With more companies implementing global manufacturing strategies and exploring nontraditional supplier relationship structures, the already wide range of supply chain-related issues is growing exponentially in complexity.
Our multidisciplinary team offers our clients a diverse array of supply chain legal expertise—from transactions, to litigation, to bankruptcy—and everything in between. We are here to develop timely and cost-effective solutions, tailored to your unique industry, that give you a true leg up on the competition.
We know the legal issues that can crop up at every level of the supply chain, whether involving unique sourcing transactions, blanket purchase orders, single source or just-in-time contracts, troubled supplier situations, and more. We excel at developing legal strategies to provide leverage, mitigate risk, and protect your specific company needs.
Representing clients throughout the supply chain, we focus on the full spectrum of supply chain management, from structuring a wide-range of complex sourcing agreements and standard purchase and sale agreements, to helping our clients maneuver effectively through disputes and supplier financial distress. We also regularly counsel clients on best practices for standardized terms and conditions, and modify when needed, ensuring our clients’ purchase and sale conditions comport with the latest legal developments.
Supplier Disputes
Before push comes to shove, we advise on unique strategies that provide leverage when your company is faced with impending supply chain disruption, such as those caused by the limited availability of material, parts, labor, and transportation, rising costs, pricing demands, tariff impositions, volume fluctuations, tooling disputes, force majeure interference, and the unique hurdles inherent with single source suppliers. We can walk you through the legal minefield often involved with replacing non-performing suppliers or non-paying customers. When litigation is unavoidable, we draw on our strength and experience to cost effectively manage our clients’ crises and protect their financial stakes—including seeking injunctive relief.
Troubled Suppliers
We help clients develop strategies to address troubled supplier situations, recognize early warning signs of financial distress, and learn how to appropriately manage a relationship when an adverse event occurs. Aiming to minimize loss and disruption, we represent OEMs needing supplies from troubled suppliers both before and during bankruptcy and lenders seeking to maximize return. We also negotiate accommodation and acquisition agreements to help weather the distress. When necessary, with a deep bench of automotive litigators, we commence litigation and seek injunctive relief—always focusing on avoiding disruption in supply chain.
