Illinois Biometric Information Privacy Act (BIPA)

Illinois’ state biometric privacy statute (“BIPA”) is the only such statute with a private right of action. BIPA has received national attention and a resulting volume of class action litigation, with hundreds of cases currently pending. Our clients in this realm include employer businesses of all sizes both across the U.S. and globally that interact with Illinois residents and that collect biometric information, such as fingerprints, hand or face scans, to track employee hours and access to restricted areas.  We also represent tech companies whose products collect, store, or transmit biometric information.

Dykema is one of the leading law firms currently defending Illinois companies against BIPA class action lawsuits, and with good reason – our attorneys are known for developing and employing aggressive strategies to resolve class actions before certification and trial, enabling us to defeat class certification and successfully cut off class actions quickly.

We lead the development of case law around the U.S. with our tremendous track record for defending high stakes class actions and applying innovative strategies to defeat or substantially reduce liability for our clients.  When it comes to trial success, we have experienced class action trial lawyers who have been identified by Chambers USA as “tremendous” and “very skilled” litigators with jury trial experience that few firms can match.  Our offices are strategically located in the “hub” jurisdictions, spanning coast to coast across the U.S., including Illinois, which is fast becoming the preferred jurisdiction for privacy class action lawsuits. With our nationwide reach, our team represents clients in both federal and state courts across the country.  When it comes to strength of expertise and proven success in the class action arena, Dykema is the partner your business wants by its side.
