Senior Counsel


Timothy J. McCarthy helps clients resolve business disputes across international borders, in American courts, and before international arbitral tribunals. He has handled matters involving dozens of countries worldwide and has acted in some of the highest-profile and highest-value cases of this century, including the Bush v. Gore litigation, the Enron bankruptcy, and the civil litigations arising out of the September 11 terrorist attacks.

Tim has extensive experience in commercial and investment disputes, fraud matters and other special situations, sanctions and trade regulatory matters, cross-border insolvency, and international asset tracing and enforcement efforts. He brings previous experience as a corporate transactions attorney to inform his advocacy strategies.

Tim represents multinationals and middle-market companies, banks, funds and investment managers, closely held concerns, and individual investors and executives.

His clients and cases have spanned common law and civil law jurisdictions and a broad range of arbitral institutions and rule sets.

He also represents U.S. and international corporate clients, as well as individual clients, in white-collar criminal proceedings, internal investigations, and regulatory enforcement matters.

He also handles dispute risk management, disciplined matter management, and innovative dispute funding and hedging strategies.

Tim regularly publishes and lectures on the law and practice of international disputes, including “International Disputes 101” courses for in-house counsel and private practice attorneys.

He also maintains a substantial pro bono practice, including U.S. felony criminal appeals and cases arising under the Hague Convention on the Civil Aspects of International Child Abduction.
